Freetown, August 28, 2026: Justice Adrian Fisher of the High Court in Freetown has issued an interim injunction restraining senior officials of the All People’s Congress (APC), the party itself, and the Political Parties Regulation Commission (PPRC) from carrying out leadership and administrative functions.
The order, delivered on Friday, August 28, follows a motion filed by Alfred Peter Conteh and Mohamed Sheridan Kamara against APC officials Alhaji Osman Foday Yansanneh, Lansana Dumbuya, the party, and the PPRC.
Under the ruling, Yansanneh and Dumbuya have been barred from performing duties associated with their positions as National Chairman and Leader and National Secretary General. The injunction also extends to all current executive members serving under the APC’s 2022 Constitution, prohibiting them from convening meetings, supervising party affairs, or holding themselves out as executive members.
Justice Fisher further suspended all actions undertaken by the APC executive since August 19, pending determination of the substantive application. He cautioned the defendants against breaching the terms of the order and directed that costs of the application be “costs in the cause.”
The injunction stems from a broader legal dispute over the legitimacy and tenure of the APC’s National Executive. The plaintiffs argue that the three-year tenure of the executive expired on February 13, 2026, and that officials occupying key positions are no longer legally mandated to serve.
They are seeking declarations that the continued occupation of offices by Yansanneh and Dumbuya contravenes Article 52(a) and (b) of the APC Constitution 2022. The plaintiffs also challenge the legality of a six-month extension granted by the PPRC, contending that while the extension itself was valid, the Commission lacked authority to transfer managerial control of the party to another group.
The substantive issues before the court include the legality of the executive’s tenure extension, the occupation of key offices, and the alleged transfer of party authority.
The interim injunction is not a final ruling on the matter. The case remains before the High Court for further hearing and determination.
