Freetown, – June 2026: Hon. Justice Mustapha Mohamed Bawoh has discharged 29‑year‑old Timothy Nabieu after the prosecution failed to present evidence against him in a case that had lingered since 2024.
Nabieu had been standing trial on two counts of office breaking and larceny, contrary to Section 26(1) of the Larceny Act of 1961. He was accused of breaking into the office of Peninsula Secondary School on June 2, 2024, and stealing items including three Dell desktop computers, two computer stands, four trumpets, and an electronic sewing machine, all valued at Le55,000.
During proceedings, defence counsel C. Taylor Young argued that the defendant had been in custody for nearly two years without progress in the matter. He noted that no witness had testified and no evidence had been led against Nabieu, and therefore applied for the case to be discharged for want of prosecution.
Justice Bawoh upheld the application, ruling that the prolonged detention without evidence was unjustifiable. The matter was subsequently struck out.
State Counsel A.B.N. Taylor‑Kamara had prosecuted the case on behalf of the State.
